1. About this policy

This policy explains how Success Tutoring Australia Pty Ltd ABN 73 642 779 735 (Success Tutoring HQ) and each independently owned Success Tutoring centre in Australia (each a Centre Operator) collect, use, share and protect personal information. “We”, “us” and “our” mean Success Tutoring HQ and the Centre Operators. The policy applies to our website, the booking and enquiry site at app.successtutoring.com, the Success Tutoring app and our centres.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. The information we collect

About parents and guardians:

  • name, email address, phone number and home address
  • payment details, which are collected and held by our payment provider rather than by us
  • your enquiry, booking and membership history, and your communications with us

About students:

  • name, year level and school
  • assessment results, learning plans, session notes, progress reports and attendance
  • Success Points (ClassDojo) activity
  • the people authorised to collect them from the centre

Health and learning information: with your consent, we collect information you choose to share that we need to keep your child safe or support their learning, such as allergies, medical conditions, emergency medication or learning needs. We collect only what is needed.

Photos and video: we take or use photos or video of a student for promotion only if you have given separate, optional consent on our Photo and Media Consent Form. You can withdraw that consent at any time.

CCTV: centres may use security cameras (video only, no audio) in appropriate areas, with signs. Footage is used for safety and security.

Website and app use: device and browser information, pages visited and how you arrived at our site, collected through cookies and similar tools (see section 10).

3. How we collect it

We collect most information directly from you: when you enquire, book an assessment, enrol, use the app or speak with your centre. We also collect information:

  • through social media lead forms you complete (for example, on Facebook or Instagram)
  • from another family who refers you, or from a person you have authorised to deal with us
  • from our payment provider and other service providers
  • from the student during sessions (for example, their work and progress)

If we receive information about you from someone else, we take reasonable steps to let you know.

4. Why we use it

  • To respond to enquiries and arrange assessments.
  • To provide tutoring, including learning plans, bookings, attendance and progress reports.
  • To manage memberships, billing and payments.
  • To keep students safe, including supervision, collection, emergencies and our child safety obligations.
  • To communicate with you about your child and your membership.
  • To support, review and improve the Success Tutoring network, including quality checks by Success Tutoring HQ.
  • To send you information about our programs and offers, which you can opt out of at any time.
  • To meet our legal obligations.

5. Children's information

Most information about students comes from their parent or guardian. We use it only to provide tutoring and to keep students safe. We do not use children's information for targeted advertising, and we do not sell it.

6. Who we share it with

  • Between your Centre Operator and Success Tutoring HQ, for the purposes in section 4.
  • Our payment providers (for example, Ezypay or Stripe), to process your payments.
  • Our technology and service providers, including our CRM and booking systems, email and SMS services, cloud hosting, learning tools and IT support. They may use your information only to provide services to us.
  • A new operator of your centre, if the centre is sold, so your membership can continue.
  • The nearest Success Tutoring centre, if your centre closes, so it can offer you a place. You can tell us you do not want this.
  • Professional advisers, such as our lawyers and accountants.
  • Government agencies, police or child protection authorities, where the law requires or allows it, including to protect a child's safety.

We do not sell personal information.

7. Information stored or accessed overseas

Some of our service providers store or process information outside Australia, including in the United States and Singapore. Success Tutoring HQ staff in New Zealand, the United States, Singapore, India and Canada may also access network systems. We take reasonable steps to make sure overseas recipients protect your information consistently with the Australian Privacy Principles.

8. Marketing

We send marketing emails and texts only where you have agreed or would reasonably expect them, such as when you are a current member. Every marketing message identifies us and includes a way to unsubscribe. You can opt out at any time by using the unsubscribe link, replying STOP or contacting us.

9. Text messages about your enquiry

When you enquire or book an assessment, you can choose to receive text messages about your enquiry, such as booking links and reminders. This is optional and is not required to book. Message frequency varies, typically up to ten messages per enquiry. Reply STOP to opt out at any time. We do not share your mobile number or messaging consent with third parties for their marketing.

10. Cookies and analytics

Our website uses cookies and similar tools to make the site work, understand how it is used and measure our advertising, including through tools provided by Google and Meta. You can block or delete cookies in your browser settings, although some parts of the site may not work properly. We do not use students' information for advertising.

11. Automated decisions

Our systems may use your membership and payment information to automatically pause new session bookings when a payment remains unpaid after notice. These decisions can affect your access to sessions under your membership. You can contact your centre to have the decision reviewed.

12. Security and how long we keep information

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including access controls on our systems. We keep student records for 7 years after the record is made, or until the student turns 25, whichever is later, and other records for as long as we need them or the law requires. After that, we securely destroy or de-identify them.

13. Accessing and correcting your information

You can ask to see the personal information we hold about you or your child, and ask us to correct it. Contact your centre or Success Tutoring HQ. We will verify your identity and respond within 30 days. There is no fee to make a request. If giving you access involves significant work, we may charge a reasonable cost, and we will tell you before we do. If we refuse access or correction, we will explain why in writing.

14. Data breaches

If a data breach is likely to cause serious harm, we will notify the people affected and the Office of the Australian Information Commissioner, as the law requires.

15. Complaints

If you have a concern about your privacy, please contact your centre first, or Success Tutoring HQ using the details below. We will acknowledge your complaint promptly and aim to respond within 30 days. If you are not satisfied, you can contact the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
